Terms of Service

This Terms of Service applies to:
COMMISSIONED WORK & ART
DESIGN COMMISSIONS AND ANY PRE-MADE DESIGNS

By purchasing my designs, artwork, or services, you agree to the following terms and conditions. Read these terms in their entirety prior to ordering. Terms may change without notice.

GENERAL USAGE AND ARTWORK RIGHTS:

General:

  • All goods provided are digital products and/or scans, including any items labeled as “traditional-medium.” By commissioning me, clients understand and accept that no physical goods will be provided.
     

You, the client:

  • Clients who are ordering work must be at least 18 years of age.

  • Clients may use the artwork on a personal, non-commercial basis only. This includes using it as an icon, social media banner, reposting it, etc. Please credit me with my username, Veraniix, when possible.

  • You may not claim the work to be your own. Editing the work is allowed under some specifications, as follows:

    • The watermark will not be removed or obscured, under any circumstances.

    • Edits may not change the overall subject or content of the work.

    • Examples of allowed editing include color overlays, effects, adding backgrounds onto transparent images, etc.

    • Edited artwork must still credit me.

  • Clients may NOT use artwork or designs from me for anything NFT (non-fungible token) related, or anything crypto-related in general.

  • Clients may add the cost of artwork from me to a character design’s resale value, but must not resell the work specifically any further.
     

I (Veraniix), the artist:

  • I do not give permission for ordered artwork to be used commercially, nor the opportunity to purchase commercial rights. This includes prior work. For designs, see “Design-Specific” below.

  • I reserve the right to reject any inquiry, for any reason.

  • I reserve the right to use the commissioned work for profit or promotional reasons. This includes using the art itself–not the character featured–on the basis of self promotion, including but not limited to examples and art books.

  • I will never claim to own a design or character that I do not have rights to. I can only claim rights to the art.

  • I will not resell commissioned artworks.
     

PAYMENT:

  • Prices are subject to change at any time.

  • Price estimates and quotes are not binding.

  • Clients who order a commission must be the owners of the Paypal account they use to purchase artwork and designs with.

  • All payment for commissions will be made with a Paypal invoice, in USD.

  • Do not send the payment until the okay is given and/or until an invoice is sent.

  • Payment is due in full up front for any commission unless stated or agreed upon otherwise. Payment plans are available for large sums of $200 and over, with a 50% deposit upfront.

  • I do not allow chargebacks or Paypal disputes. If you have any questions, concerns, or would like to request a refund, you may contact me via my socials or email at any time.
     

REFUNDS/CANCELLATIONS:

  • Commissions cancelled by the artist receive a full refund. 

  • Commissions cancelled by the client may receive a refund based on the status of the artwork or design at the time

    • ​Orders that are not past the sketch phase can receive a 75% refund.

    • Orders that are past the sketch phase can receive a 25%-50% refund, depending on how far I’ve gotten with it.

    • Completed commissions and designs are ineligible for refunds.

    • All pre-made and “adoptable” character design sales are final.

  • Client-cancelled orders cannot be resumed at a later date.

  • Clients may not use any progress shots, sketches, artwork, or designs from orders they’ve cancelled.

  • Artist may finalize client-cancelled designs for sale at a further date.
     

PROCESS:

WIPs and Edits:

  • You’ll receive a sketch via your preferred communication method (social media DMs or email) to confirm you are satisfied with the current product.

  • All work in progress shots after the initial sketch must be requested, as I will only provide the initial sketch.

  • If the artist misses a marking or character feature that was shown on the reference, no matter what stage the commission is in, it will be fixed with no charge.

  • Any missing details on the commission not originally shown on the reference will be charged an additional fee to adjust. Please make sure the reference provided is accurate.

  • Any large edits (posing, composition, etc.) MUST be made before moving on from the sketch phase, and will not be made after the client approves the sketch.

  • Other edits after the sketch phase may be made, but will incur a fee.
     

Reference(s):

  • Client is expected to provide a clear visual reference. I will not work off of descriptions.

  • Client should only provide images they have the rights to use.

  • Again, please make sure the reference is accurate.
     

Wait Time:

  • I do not take rush commissions, or orders with a short notice deadline.

  • Turnaround time is variable, and heavily depends on the complexity of the commission as well as the artist's life situation. Estimated range can be 1-2 weeks up to 1-2 months.

  • If you’re looking for very fast work, please understand that I cannot guarantee how fast a commission can be completed. I appreciate patience, and am able to provide progress shots at any stage.

  • Asking for progress and updates too frequently (hourly/daily) will be considered harassment, and can result in your commission being cancelled.
     

DELIVERY:

  • Commissions and designs are delivered through email or DMs (messages will include an external link to the image), as a full-sized, watermarked image.

  • All work is watermarked, and the watermark will not be removed under any circumstances. Watermark design may change yearly, or look different depending on the type/size of commission.

  • Client is not entitled to an unwatermarked copy, layered file, or any other additional files outside of what was specified in the original order.

  • Commissioner may ask to keep the commission private for a short, specified time if the artwork or design is, for example, a gift.

  • I will not take fully private commissions–all commissions may be posted on my socials or as an example on my website(s). Clients, however, can choose to remain anonymous, and I will not mention them by name.
     

DESIGN-SPECIFIC:

  • Any designs created for a closed species must adhere to the species rules first and foremost.

  • Co-owning any of my designs is not allowed.

  • Clients may make minor edits to character designs. These edits must be done on a new piece of artwork, and must not overhaul or completely redesign the character to the point they’re unrecognizable.

  • For design work, the artist retains rights over:

    • The original design and concept.

    • Ownership of the original art of said design.

    • The ability to create similar or derivative designs.

  • Character designs may be used commercially–NOT the original artwork of the design. Any designs used commercially must be properly credited, and I must be notified of the use.

  • Character designs may only be sold for as much as the initial sale price.

    • Value of commissioned artwork from other artists may be added to the resale value as long as this is allowed by the other artists Terms.
